These Website Terms & Conditions ("Terms") govern Your access to and use of the websites located at heppnergroup.com and heppnerinsurance.com, and any other website or online property that links to these Terms (collectively, the "Website"), including all contact forms, file-upload features, and related online functionality, owned and operated by Heppner Insurance Group, LLC ("Heppner Group," "Company," "We," "Us," or "Our"). These Terms do not govern the provision of insurance products or the terms of any insurance policy, which are governed by the applicable insurance carrier's policy documents.

By accessing or using the Website, submitting information through the Website, or clicking "Submit" or “Accept” on any form, You agree to be bound by these Terms and Our Privacy Policy. If You do not agree to these Terms, do not use the Website or submit information through it. Our Privacy Policy, available on the Website, describes how We collect, use, disclose, and protect Your information and is incorporated into these Terms by reference. In the event of a conflict between these Terms and the Privacy Policy, the Privacy Policy controls with respect to privacy, data collection, data use, data disclosure, consumer privacy rights, and information-security matters, and these Terms control with respect to all other matters.

1. Nature of Services

Heppner Group is a licensed independent insurance agency . The Website is a lead-generation and informational resource designed to help consumers learn about and request information regarding insurance products. The Website does not permit You to complete an insurance enrollment or bind coverage online. All insurance applications, enrollments, and coverage decisions are handled by a licensed agent and are subject to carrier underwriting, eligibility requirements, and plan availability. Heppner Group may help consumers review, compare, and enroll in a variety of insurance products, which may include:

  • Medicare Advantage (Part C) plans

  • Medicare Supplement (Medigap) insurance plans

  • Medicare Part D prescription drug plans

  • Special Needs Plans (SNPs)

  • Affordable Care Act (ACA) marketplace plans, individual and family health plans

  • Short-term medical plans

  • Life insurance, including term, whole, and universal life

  • Final expense and burial insurance

  • Cancer, heart attack, stroke, and other critical illness coverage

  • Hospital indemnity and accident insurance

  • Dental, vision, and hearing (DVH) plans

  • Other ancillary and supplemental insurance products

Government Affiliation Disclaimer: Heppner Group is not affiliated with, endorsed by, connected to, or authorized by the U.S. Government, the federal Medicare program, the Centers for Medicare & Medicaid Services (CMS), the Social Security Administration, the Health Insurance Marketplace, or any state government agency. Communications from Heppner Group may be considered solicitations for insurance. A licensed agent may contact you.

3. State Licensing

Heppner Group is a licensed insurance agency authorized to do business in all fifty (50) states. Heppner Group’s National Producer Number (NPN) is 19156410. Individual licensed agents are appointed and authorized to sell insurance products only in the states in which they personally hold an active producer license, the appropriate carrier appointments, and, for Medicare Advantage and Part D plans, annual AHIP or equivalent certification and carrier-specific certifications. 4. Consent to Contact; TCPA Disclosure

SMS marketing is excluded from the general contact authorization described in this section. Submitting a form does not enroll a user in the SMS program. SMS marketing consent is obtained only through a separate and optional SMS opt-in process described in Section 8.

By clicking "Submit" or “Accept” on any form on the Website, You provide Your prior express written consent under the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and the Electronic Signatures in Global and National Commerce Act ("E-SIGN Act"), 15 U.S.C. § 7001, for Heppner Group and service providers acting on Heppner Group's behalf, to contact You for marketing, informational, appointment-setting, application, enrollment, policy-servicing, and insurance-related purposes regarding the products and services described in Section 1 of these Terms. This consent authorizes contact at any telephone number, mobile number, email address, mailing address, or other contact point You provide, using one or more of the following channels and technologies, subject to applicable law:

  • Telephone calls, including live-agent calls, calls placed using an automatic telephone dialing system or similar technology, prerecorded or artificial voice messages, ringless voicemail, and similar or successor technologies

  • Email, including marketing , informational, and service-related emails

  • Direct mail and postal communications

  • Digital advertising, including remarketing, retargeting, and matched-audience advertising on websites, search engines, social media platforms, and advertising networks, as further described in Our Privacy Policy

  • Other communications technologies that We may adopt, to the extent permitted by applicable law

5. Wireless Numbers and Do Not Call Registries

You confirm that You are the subscriber, account holder, customary user, or authorized user of any telephone number or other contact point You provide. You authorize Heppner Group to contact You at those numbers and contact points, including wireless and cellular numbers, even if they appear on a federal, state, or internal do-not-call list, to the fullest extent permitted by applicable law. Your consent is given solely to Heppner Group (and parties acting on Heppner Group's behalf) and does not authorize unaffiliated third parties to contact You for their own independent marketing purposes. Your consent is not being shared with or transferred to any other seller or entity.

6. Consent Is Not a Condition of Purchase or Enrollment

You are not required to provide consent to be contacted as a condition of purchasing any goods or services or enrolling in any insurance product. You may obtain information about Medicare and available plans through other means, including by contacting Us directly at 888-700-0126 or info@heppnergroup.com, by calling 1-800-MEDICARE (1-800-633-4227, TTY 1-877-486-2048), by visiting Medicare.gov or Healthcare.gov, by contacting Your local State Health Insurance Assistance Program (SHIP), or by contacting Your state Department of Insurance.

7. Scope of Appointment (SOA) — Medicare Advantage and Part D

You understand that these Terms do not constitute a Scope of Appointment (SOA) and do not authorize a licensed agent to discuss specific Medicare Advantage or Medicare Part D plans with you unless a valid SOA or other CMS-permitted authorization applies. Under CMS rules, before a personal marketing appointment or conversation in which specific Medicare Advantage or Part D plans will be discussed, you generally must complete a separate Scope of Appointment that:

  • Identifies the specific product types to be discussed

  • Is completed before any plan-specific discussion begins;

  • Is documented in writing for in-person appointments and otherwise documented in a CMS-permitted form for telephone, online, or other qualifying interactions

  • Is retained by Heppner Group for at least ten (10) years

You may decline to complete a Scope of Appointment, decline to discuss any product, or end any appointment at any time.

8. SMS Program Terms

By separately and voluntarily opting in, users may receive recurring marketing text messages from Heppner Group Medicare Guidance. Messages may include Medicare educational information, general Medicare plan information, invitations to educational events, promotional information about Heppner Group’s services, and invitations to contact a licensed insurance agent.

Medicare educational and general plan-information messages sent through this program are categorized as marketing because they may promote Heppner Group’s services or encourage recipients to contact a licensed insurance agent. Messages may be sent to prospective or existing customers who have expressly opted in.

This short-code program is limited to Marketing SMS. Customer Care SMS, including policy-support conversations, troubleshooting, appointment changes, and general support inquiries, is not included in this short-code program.

Message frequency varies. Message and data rates may apply.

Reply STOP to opt out. After replying STOP, you may receive one final message confirming that you have been unsubscribed.

9. Email Communications

Email communications will comply with the CAN-SPAM Act. Every marketing email will include an unsubscribe link and our physical postal address: 2600 Eagan Woods Drive, Suite 135, Eagan, MN 55121.

10. Call Recording and Retention

You acknowledge and agree that telephone communications between you and Heppner Group may be monitored and recorded for quality assurance, training, regulatory compliance, and legal purposes, in accordance with applicable federal and state laws. To the extent required by CMS at 42 C.F.R. § 422.2274(g) and § 423.2274(g), marketing and sales calls between Heppner Group and Medicare beneficiaries regarding Medicare Advantage or Part D products will be recorded and retained in accordance with CMS requirements. For CY2027 marketing, CMS requires retention for six (6) years: audio recordings for years one through three, and either audio recordings or complete and accurate transcripts for years four through six. Enrollment records and other records subject to separate CMS, carrier, or legal retention requirements may be retained for ten (10) years or longer. Calls regarding non-Medicare products may also be recorded for quality and compliance purposes.

11. Health Information and HIPAA

You understand that health-related information you voluntarily provide to Heppner Group may be used to assist with quoting, comparing, applying for, enrolling in, underwriting, servicing, or administering insurance products. Heppner Group will handle this information in accordance with applicable privacy, insurance, consumer-protection, and health-data laws and its Privacy Policy. Heppner Group is not a health plan, health care clearinghouse, or health care provider merely because it operates the Website, and these Terms do not state that Heppner Group is a covered entity under the Health Insurance Portability and Accountability Act ("HIPAA"). If HIPAA, the Gramm-Leach-Bliley Act, state insurance privacy laws, the Washington My Health My Data Act, or other health-data laws apply to a particular product, transaction, or relationship, Heppner Group will handle information in accordance with those applicable requirements and its Privacy Policy.

12. Licensed Agent and Compensation Disclosure

You understand that Heppner Group’s representatives are licensed insurance agents who may receive compensation (including commissions, overrides, bonuses, and administrative payments) from insurance carriers for plans and policies in which you enroll. The amount of compensation does not affect your premium and is paid by the carrier, not by you. Compensation amounts vary by carrier, product, and plan, and disclosure of specific commission amounts is available upon request where required by law.

13. Revoking Consent

You may revoke this consent at any time, through any reasonable method, including:

  • Replying STOP to any marketing text message

  • Clicking “unsubscribe” in any marketing email

  • Stating your request to opt out verbally during any phone call

  • Contacting us at 888-700-0126 or info@heppnergroup.com

We will honor opt-out and consent-revocation requests within the timeframes required by applicable law, and no later than ten (10) business days where the TCPA requires that timeframe. You may revoke consent through any reasonable method that clearly communicates your desire not to receive further calls or texts.

Revoking TCPA consent or opting out of calls, texts, or emails does not automatically disable cookies, pixels, or targeted-advertising technologies. Please refer to Our Privacy Policy for information about how to manage cookies, opt out of targeted advertising, and exercise any applicable state privacy rights.

14. Eligibility and Authority

You confirm that you are at least 18 years of age, that the contact information you provided belongs to you (or that you are legally authorized to provide it on behalf of another person, such as a spouse, dependent, parent, or person for whom you serve as an authorized representative or power of attorney), and that all information you provided is accurate and truthful.

15. Privacy

Your use of the Website is subject to Our Privacy Policy, which describes how We collect, use, disclose, and protect Your personal information, including any health-related information You provide. The Privacy Policy also describes Your rights under applicable state consumer privacy laws, Our use of cookies and tracking technologies, and how to exercise opt-out rights. 16. SMS Consent Sharing

Heppner Group will not sell, rent, share, or transfer Your mobile phone number, SMS opt-in data, or SMS consent records to unaffiliated third parties for their own independent SMS marketing or promotional purposes. Heppner Group may share such information with service providers that assist in delivering messaging services, solely as necessary to operate Our SMS program, maintain consent and opt-out records, and comply with applicable law. Heppner Group does not share Your consent with, or transfer Your consent to, any other seller or entity for that seller's or entity's own independent marketing. 17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict-of-law principles. Nothing in these Terms limits the applicability of any federal law (including the TCPA and CMS regulations) or any consumer protection law of Your state of residence that applies by its own terms.

18. Electronic Signature

By clicking "Submit" or “Accept” on any form on the Website, You (a) electronically sign and agree to these Terms under the E-SIGN Act, 15 U.S.C. § 7001, and applicable state electronic signature laws; (b) acknowledge that You have read, understood, and agree to these Terms and Our Privacy Policy; (c) authorize the contact methods described in Section 4 of these Terms; and (d) confirm that Your electronic signature has the same legal effect as a handwritten signature. Before submitting a form electronically, You should be provided E-SIGN consumer disclosures stating the hardware and software requirements for accessing and retaining electronic records, Your right to receive paper copies, Your right to withdraw consent to electronic records and any consequences of withdrawal, and the procedures for updating Your contact information. For clarity, clicking “Submit” or “Accept” does not constitute consent to receive SMS marketing messages. SMS marketing requires a separate and optional opt-in.

19. File Uploads

The Website permits You to upload files (in PDF, DOC, DOCX, JPG, and PNG formats) through the Contact Us form. By uploading a file, You represent that You have the right to share the contents of the file and that the file does not contain any virus, malware, or harmful code. You grant Heppner Group a nonexclusive, worldwide, royalty-free license to access, use, copy, store, transmit, and process uploaded files solely as reasonably necessary to respond to Your inquiry, provide requested services, maintain records, comply with legal obligations, and operate the Website. You are solely responsible for the content of any file You upload. Heppner Group is not responsible for the security of information contained in uploaded files beyond commercially reasonable measures. Do not upload documents containing sensitive personal information (such as Social Security numbers, financial account numbers, or other information beyond what is needed for Your insurance inquiry) unless specifically requested by a licensed agent. Uploaded files will be handled in accordance with Our Privacy Policy.

20. Intellectual Property; Ownership

The Website and its content, including text, graphics, logos, service names, page layouts, icons, and other materials, are owned by Heppner Group or its licensors and are protected by copyright, trademark, and other intellectual-property laws. Except as expressly permitted by these Terms, You may not copy, modify, distribute, display, perform, publish, license, create derivative works from, or exploit any Website content without prior written permission. Nothing in these Terms grants You any ownership interest in the Website or any Heppner Group trademarks, trade names, logos, or service marks.

21. Indemnification

To the fullest extent permitted by applicable law, You agree to defend, indemnify, and hold harmless Heppner Group, its officers, directors, members, managers, employees, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising out of or relating to Your violation of these Terms, Your use of the Website, Your uploaded files or submitted content, Your violation of any law or the rights of any third party, or Your misrepresentation of authority to provide information or consent on behalf of another person.

You agree to use the Website only for lawful purposes and in accordance with these Terms. 25. State Calling and Texting Laws

Heppner Group will comply with applicable federal and state laws governing calls, texts, prerecorded or artificial-voice messages, autodialing, do-not-call obligations, quiet hours, caller identification, consent, and revocation. These laws may include state mini-TCPA and telemarketing laws, such as the Florida Telephone Solicitation Act, Oklahoma Telephone Solicitation Act, Maryland calling and text-messaging restrictions, and other state-specific requirements. Where applicable law imposes stricter consent, calling-window, do-not-call, disclosure, or revocation requirements than these Terms, Heppner Group will follow the stricter applicable requirement.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEPPNER GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEPPNER GROUP, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE WEBSITE, THESE TERMS, OR ANY INFORMATION OR SERVICES OBTAINED THROUGH THE WEBSITE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF HEPPNER GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 28. Dispute Resolution; Binding Arbitration; Class-Action Waiver

(a) Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or communications or services provided by or on behalf of Heppner Group in connection with Your use of the Website or Your submission of information through the Website (collectively, "Disputes"), that is not resolved informally, shall be resolved exclusively by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect, subject to any applicable JAMS Consumer Minimum Standards. The arbitration shall be conducted in the county and state of Your residence, by telephone or videoconference, or at another mutually agreed location, unless the arbitrator determines that another forum is required by applicable law. The arbitrator shall apply the substantive law of the State of Minnesota, applicable federal law including the Federal Arbitration Act, 9 U.S.C. §§ 1–16, and any non-waivable consumer protection law of Your state of residence that applies by its own terms. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

(b) Class-Action Waiver; Mass-Arbitration Procedures. YOU AND HEPPNER GROUP AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, MULTI-PARTY, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. If twenty-five (25) or more substantially similar demands for arbitration are filed against Heppner Group by or with the assistance of the same law firm, organization, or coordinated group, the parties agree that the arbitrations may be administered in batches of up to fifty (50) demands at a time, with filing, administrative, and arbitrator fees assessed only for the batch then proceeding, unless JAMS or the arbitrator determines that a different process is required by applicable law or JAMS rules. IF THIS CLASS-ACTION WAIVER IS FOUND TO BE UNENFORCEABLE WITH RESPECT TO A PARTICULAR CLAIM OR REQUEST FOR RELIEF, THEN THAT CLAIM OR REQUEST FOR RELIEF SHALL BE SEVERED AND PROCEEDED IN A COURT OF COMPETENT JURISDICTION, AND THE REMAINING CLAIMS SHALL CONTINUE IN ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW.

(c) Small Claims Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court in Hennepin County, Minnesota (or the county in which You reside), provided the claim falls within the jurisdictional limits of the small claims court.

(d) Informal Resolution. Before initiating arbitration, You agree to first contact Us at info@heppnergroup.com to attempt to resolve the Dispute informally. If the Dispute is not resolved within thirty (30) days of the initial notice, either party may proceed to arbitration.

(e) Thirty-Day Opt-Out. You may opt out of this arbitration provision by sending written notice to Heppner Group at info@heppnergroup.com within thirty (30) days after the date You first agree to these Terms. Your opt-out notice must include Your name, telephone number or email address used on the Website, and a clear statement that You opt out of arbitration. Opting out of arbitration will not affect any other provision of these Terms.

29. Changes to These Terms

Heppner Group reserves the right to modify or update these Terms at any time by posting the revised Terms on the Website and updating the "Last Updated" date at the top. Your continued use of the Website after any such changes constitutes Your acceptance of the revised Terms. We encourage You to review these Terms periodically. If You do not agree to the revised Terms, You must stop using the Website.

30. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or, if modification is not possible, it shall be severed from these Terms.

31. Entire Agreement
